In 2007, Kirby J. Colling was a 21-year-old college student, working his way to becoming a Buffalo police officer. He has an associate degree in criminal justice, served as an intern for a number of different law enforcement agencies, and he was also working at Hanes Supply delivering documents to Frontier Fibers, a locally owned waste paper and metal recycling facility.
While he was there he was pinned against the shredding machine by a new forklift driver, who was neither properly trained, nor certified to operate the machine. The results were disastrous. Colling fractured his lower back and sustained other injuries that resulted in artificial disk replacement surgery. This left him disabled and unable to continue his law enforcement career choice.
After 6 years, the State Supreme Court awarded Colling 10.1 million dollars after he sued Frontier Fibers for his injuries. It was a very hard-fought case that resulted in justice being given to Mr. Colling. The awards included past and future medical expenses, past and future earnings, and past and future pain and suffering.
